PUBLIC NOTICE NOTICE OF PUBLIC HEARING REGARDING THE RENEWAL OF AIR Duke Energy has applied to the North Carolina Department of Environment and Natural Resources, Division of Air Quality (DAQ) for the renewal of their existing air quality permit for the Cliffside facility located at 573 Duke Power Road, Cliffside, North Carolina in Rutherford County. In October 2009 the DAQ issued a public notice requesting public comment on its preliminary decision to renew the existing permit. Comments were received requesting a public hearing. Based on the comments received the Director of the DAQ has determined that a hearing is in the best interest of the public. Therefore a public hearing will be held on Thursday January 14, 2010 between 6:00 pm and 9:00 pm at Chase High School located at 1603 Chase High Road in Forest City, NC. Speakers may be allowed up to 3 minutes to deliver their remarks, but the hearing officer will have the discretion to reduce speaking times, as necessary, to accommodate the number of commentors.
The current air quality permit contains terms authorized under 15A NCAC 2Q .0500 "Title V Procedures" as well as terms authorized under 15A NCAC 2Q .0300 "Construction and Operation Permits." Those terms authorized under the Title V Procedures are being renewed in accordance with 15A NCAC 2Q .0513 and those terms authorized under the Construction and Operation Permits are being renewed in accordance with 15A NCAC 2Q .0304. Unit 6, which is presently under construction, is not required to obtain a Title V operating permit until after it begins operation. Therefore, Unit 6 is not being reviewed under the Title V Procedures at this time. After considering all comments from the hearing and all written comments postmarked by January 22, 2010, and other available information on the permit, the DAQ will make a final decision on the renewal request.
