NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION

PUBLIC NOTICE

Notice is hereby given for a public hearing to be heard by the North Carolina Department of Environment and Natural Resources, Division of Air Quality concerning the proposed adoption or modifications to air toxic rules, special order rules, permitting rules, concrete batch plant rule, nitrogen oxide rules, open burning rules, volatile organic compound rules, and municipal waste combustor rule.

PURPOSE:

FIRST HEARING: To receive comments on amendment of air toxic rules to revise acceptable ambient level for hydrogen sulfide, exemptions, and modifications.

SECOND HEARING: To receive comments on the adoption of special order rules and notification in non-zone areas rule and amendment of ethylene oxide and permit fee rules

THIRD HEARING: To receive comments on the adoption of concrete batch plant rules and amendment of nitrogen oxide, open burning, tank, VOC applicability, and cotton gin rules.

FOURTH HEARING: To receive comments on the amendment of municipal waste combustor rule.

NOTE:The proposed adoptions and amendments considered in this hearing, if adopted, will be effective statewide; if they are later adopted by a local air pollution control agency, then that agency will enforce them in its area of jurisdiction.

Rules and amendments are proposed to become effective February 1, 2004.

COMMENT PROCEDURES:

All persons interested in these matters are invited to attend the public hearing. Any person desiring to comment is requested to submit a written statement for inclusion in the record of proceedings at the public hearing. The hearing officer may limit oral presentation lengths if many people want to speak. The hearing record will remain open until December 15, 2003, to receive additional written statements. To be included, the statement must be received by the Division by December 15, 2003.
